01 (Paragliding / Paramotoring / Tandem Joyrides)
I, the undersigned, hereby acknowledge and understand that Paragliding, Paramotoring (Powered Paragliding), Tandem Flying and allied aero adventure activities are high-risk activities involving inherent dangers that may result in serious injury, permanent disability, death or property damage. In consideration of being permitted to participate in any such activity conducted by PARAMOTOR INDIA (hereinafter known as the released party/Operator) at Malgund, Ratnagiri, or any other authorized site, I voluntarily agree as follows:
I hereby release, waive and forever discharge PARAMOTOR INDIA, its Directors, Officers, employees, pilots, instructors, staff, contractors, volunteers, and all landowners or persons permitting use of land or site (hereinafter referred to as the “Released Parties”) from any and all claims, liabilities, demands, actions or causes of action, arising out of or related to my participation in these activities, including those resulting from negligence, acts, omissions, weather conditions, terrain, equipment failure or pilot judgment, except for liability arising from gross negligence, wilful misconduct, or statutory breach.
I voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or connected with my participation in the activity. I understand that no guarantee of safety has been given and acknowledge that adventure flight activities are inherently dangerous and may involve risks including injury, disability or death, equipment failure, weather changes, hard landings or collisions, errors of judgment, third-party interference, or emergency landings, which may occur even when all reasonable safety precautions are taken.
I expressly affirm and declare that my decision to participate in the adventure flight activity is made of my own free will and volition, without any force, pressure, inducement, undue influence, misrepresentation, or coercion of any nature whatsoever. I confirm that the nature, scope, and risks associated with the activity have been adequately explained to me in a manner that I understand, and that I have been given sufficient opportunity to ask questions, seek clarifications, and obtain explanations regarding the activity, equipment, safety procedures, and potential risks involved, all of which have been satisfactorily addressed prior to my participation.
I agree that I will not initiate or support any legal or compensation claim against the Released Parties for any injury, death or damage suffered by me during or in connection with these activities. I acknowledge that such risks may not be covered by insurance.
I hereby agree to indemnify, defend and hold harmless the Operator, its proprietors, partners, directors, instructors, pilots, employees, agents and representatives from and against all claims, liabilities, losses, damages, costs and expenses, including reasonable legal fees, arising directly or indirectly from (i) any third-party claim connected with my acts, omissions, conduct, or non-compliance with instructions during the activity; (ii) any breach of the terms, declarations, or obligations under this Agreement; or (iii) any false, incomplete, or misleading statement made by me regarding my health, fitness, age, eligibility, or suitability to participate. This indemnity shall include civil liability, compensation, penalties, and defence costs, and shall survive the completion or cessation of my participation in the activity.
I declare that I am medically fit to participate in the activity, am not under the influence of alcohol or drugs, and have truthfully disclosed all relevant medical conditions and my age to the Operator. I confirm that I do not suffer from any condition, including but not limited to heart disease, epilepsy, severe asthma, recent fractures, pregnancy, or any other condition that may increase risk. I authorize the Operator to arrange emergency medical treatment, if required, at my own risk and expense, and I accept full responsibility for any consequences arising from non-disclosure or misrepresentation.
I agree and undertake to strictly comply with all safety instructions, directions, briefings, and protocols issued by the Operator, instructors, or pilots before, during, and after the activity. I further undertake to properly wear and use all safety equipment provided to me, including but not limited to harnesses, helmets, reserve systems, and any other protective gear, and acknowledge that such equipment is essential for my safety. I agree to refrain from any reckless, negligent, unsafe, or unauthorized conduct, including interference with equipment or deviation from instructions, which may endanger myself, the pilot, or others. I expressly acknowledge and accept that any failure or refusal on my part to comply with safety instructions or equipment requirements may, at the reasonable discretion of the Operator, result in suspension, termination, or denial of
my participation in the activity, and that in such circumstances, I shall not be entitled to any refund, compensation, or claim of any nature whatsoever.
I acknowledge and understand that adventure flight activities may not be covered under standard personal or health insurance policies, and that it is my sole responsibility to obtain any personal accident, medical, or travel insurance coverage that I may consider necessary. I further acknowledge that any insurance maintained by the Operator, if applicable, is limited in scope and is not intended to, and does not, substitute or replace my own personal insurance coverage. This agreement shall be governed by Indian law, and any dispute shall be subject to the exclusive jurisdiction of courts at Pune, Maharashtra.
I confirm that I have read, understood and voluntarily agreed to this waiver and indemnity. I have understood this and voluntarily accept it. This agreement shall be binding upon me and my legal heirs.
